The initial ruling, handed down in 2022, stemmed from a case brought by Brazil's Administrative Council for Economic Defense (CADE), which accused Apple of abusing its dominant market position by forcing developers to distribute apps solely through the App Store. CADE argued this restricted competition and harmed consumers, constituting anti-competitive behavior. The agency ordered Apple to enable sideloading within 90 days, allowing users to download and install apps from third-party app stores, under threat of significant daily fines exceeding $40,000.

The ruling garnered significant attention, signaling a strengthening of regulatory scrutiny over large tech companies. Many argued that mandatory sideloading would break Apple's closed ecosystem, fostering competition and offering consumers more choices. Apple implemented this in iOS 17.4 and iPadOS 18 for EU users. Without the overturned ruling, Brazil might have faced a similar situation.

However, CADE can still appeal the March 18th decision, meaning Apple might ultimately be forced to enable sideloading. The legal battle could continue for months, if not longer, with an unpredictable final outcome. While this overturning buys Apple crucial breathing room, the fight over app distribution models is far from over, and the battle between Apple and Brazilian regulators continues.
