A Quebec lawyer is calling for a class action lawsuit against Apple, alleging the company refuses to repair any iPhones damaged by water despite advertising them as being waterproof. This follows a similar lawsuit in New York in 2022, which was ultimately dismissed. The Quebec law firm LPCAvocats is representing a 19-year-old student who says his iPhone came into contact with water near a swimming pool.
As reported by CTV News Montreal, lawyer Joey Zukran explained how Apple refused to repair the student's iPhone because it had come into contact with water. "So the warranty says it doesn't cover liquid contact damage. If you look at Apple's marketing, it's completely absurd," Zukran said. "How can you exclude repairs for water damage when you're advertising it as being able to go in the pool?"
Zukran is seeking authorization to file a class action lawsuit against Apple on behalf of the student and all others in the province facing similar situations. Specifically, the lawsuit demands Apple abolish its "liquid contact" disclaimer, reimburse all repair costs, and pay each individual $500 in damages.
"The contract essentially says your phone is 'splash-proof' and you can throw it in the pool and it'll be fine, but then a few paragraphs down it says liquid contact will void your warranty," he continued. "So there are two contradictory clauses in the consumer contract, and in law, the interpretation of these clauses has to be in favor of the consumer or adherent."
Previously, Zukran filed a lawsuit against Apple regarding iPhone battery life issues. That lawsuit was initiated in 2019, and the Quebec Apple court ultimately upheld a verdict against Apple.
This lawsuit raises concerns about Apple's "waterproof" marketing and consumer rights. Many consumers believe that Apple has exaggerated the "waterproof" feature in its advertising, misleading consumers and then refusing to take responsibility when their phones experience water damage.
The ultimate outcome of this class action lawsuit remains to be seen, but it will undoubtedly be a legal and ethical test for Apple.
