The Federal Aviation Administration (FAA) has announced plans to fine SpaceX over $630,000 for failing to comply with regulations during two launches last year. In response, SpaceX CEO Elon Musk swiftly threatened a countersuit, accusing the FAA of "regulatory overreach."
The FAA stated that both of SpaceX's violations were related to the launch mission of the PSNSATRIA project. The mission, carried out on June 18, 2023, from the Cape Canaveral Space Force Station in Florida, successfully launched an Indonesian communications satellite into orbit using a Falcon 9 rocket.
According to the FAA, SpaceX had submitted a request in May of last year to modify its launch license's communication plan, including adding a new launch control room and removing a detailed pre-launch readiness check two hours before launch. However, SpaceX implemented these changes in the PSNSATRIA mission before the FAA formally approved them.
As a result, the FAA decided to levy a $175,000 fine for each unauthorized adjustment to the launch process, totaling $350,000.
On July 28 of the same year, SpaceX drew the FAA's attention again when it launched the Jupiter 3 telecommunications satellite from NASA's Kennedy Space Center using a Falcon Heavy rocket. To complete this launch, SpaceX used a newly constructed propellant facility at Kennedy Space Center for the first time, but this facility did not receive approval until after the mission. Although SpaceX had submitted an application earlier, it was not approved before launch. Consequently, the FAA proposed a $283,009 fine for SpaceX's unauthorized use of the unapproved facility in the Jupiter 3 launch, bringing the total fine to $630,000.
Following the FAA's issuance of the two enforcement notices, SpaceX has 30 days to respond. SpaceX can choose to hold an informal meeting with the FAA legal team or submit relevant materials for consideration as their response.
In response to the FAA's proposed fine, Musk reacted quickly on social media, stating: "SpaceX will sue the FAA over their regulatory overreach!" However, he did not provide further details.
SpaceX's dissatisfaction with the FAA and its regulatory framework is no secret and has been frequently expressed publicly. For instance, SpaceX released a lengthy blog post last week sharply criticizing the current regulatory environment for space launches. SpaceX wrote in the post: "Sadly, we remain mired in the frustrating reality that approvals by the government for rocket launches take far longer than it takes to design and build space hardware. This is not only illogical, but it directly threatens Americas leadership in space exploration."
